Terms and Conditions for [Knowing Hand LLC] Woodworking Classes

1. Introduction

1.1 Overview of Terms and Conditions Welcome to Knowing Hand [Knowing Hand LLC] ("we," "us," or "our"). These Terms and Conditions govern your participation in our woodworking classes. By registering for a class, you agree to abide by these terms. Please read them carefully.

1.2 Acceptance of Terms By enrolling in a class, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

1.3 Modifications to Terms We reserve the right to update or modify these Terms and Conditions at any time. Changes will be posted on our website and will become effective immediately. Your continued participation in classes after any such changes constitutes your acceptance of the new terms.

2. Registration and Enrollment

2.1 Eligibility Requirements Participants must be at least [18] years old to enroll in our classes. Certain classes may have additional prerequisites or skill requirements.

2.2 Registration Process To register, complete the enrollment form on our website or in person at our facility. All required fields must be filled out accurately.

2.3 Class Scheduling and Availability Classes are scheduled based on demand and instructor availability. We will do our best to accommodate your preferred schedule but cannot guarantee specific class times.

2.4 Age Restrictions Classes may have age restrictions. Check individual class descriptions for details.

2.5 Maximum Class Size Classes have a maximum capacity to ensure quality instruction and safety. Enrollment is on a first-come, first-served basis.

3. Fees and Payments

3.1 Class Fees and Payment Structure Class fees are detailed on our website and are due at the time of registration. Fees vary based on class length, content, and materials provided.

3.2 Payment Methods We accept payment via [Credit Card, Debit Card, Or Cash in Person.]. All payments must be processed through our secure payment system.

3.3 Refund and Cancellation Policies

  • Refunds: Refunds are available up to [3] days before the class start date, minus a [10]% administrative fee. No refunds will be issued within [1] day of the class start date.

  • Cancellations by Us: If we cancel a class, you will be offered a full refund or an alternative class. You will be contacted via the email you used to register. If you do not indicate a preference of a refund or reschedule, you will be sent a refund after 7 days of the email notice.

3.4 Discounts and Promotions Discounts and promotions are applied at the time of registration and may have specific terms and conditions. These offers are subject to change and may not be combined with other discounts.

4. Class Conduct and Attendance

4.1 Class Start and End Times Classes start promptly at the scheduled time. Please arrive at least [10] minutes early to ensure you are ready to begin.

4.2 Attendance Requirements Regular attendance is important for completing the class. Absences should be reported to us as soon as possible. Missed classes for students following a multi-class course can be rescheduled for an additional fee that will be generated upon request.

4.3 Late Arrivals and Early Departures Late arrivals may disrupt the class and could lead to missed instruction. Early departures are discouraged. Safety instructions that occur at the beginning cannot be missed. If too much instruction has been missed by a tardy student, the instructor may not be able to brief tardy students without neglecting other students. Late arrivals may be turned away and considered a “no show” and will be ineligible for a refund. Late arrivals, even if permitted entrance, will not be given additional class time and will still be expected to finish within the allotted class period.

4.4 Missed Classes and Make-Up Sessions Make-up sessions are not guaranteed. If a class is missed, participants should contact us to discuss possible options.

4.5 Participant Responsibilities Participants are responsible for their own learning and behavior. Disruptive behavior will not be tolerated and may result in dismissal from the class.

5. Health and Safety

5.1 Safety Guidelines and Equipment Usage Participants must follow all safety guidelines provided by the instructor and use equipment as directed. Personal protective equipment (PPE) must be worn as required. Closed-toed shoes are required when working in the woodshop. Attendees who arrive without closed-toed shoess will be turned away.

5.2 Participant Health and Safety Obligations Participants should inform the instructor of any health conditions or allergies that may affect their participation. We will attempt to make accommodations within reason, including instructor assistance, or temporary modification of workstations.

5.3 Emergency Procedures In case of an emergency, follow the instructor’s directions and call [911].

5.5 Liability Waivers and Release of Claims By participating in our classes, you agree to release [Knowing Hand LLC] from any liability for injuries or damages that occur during class, except where caused by our negligence. Students are responsible for working within their comfort zones. If you elect to use tools without direct supervision, you are assuming the risk of injury because you believe yourself to be safe and informed. If you are unsure of a safe method of working, wait and seek an instructor for help before continuing.

5.6 First Aid and Medical Emergencies In the event of a medical emergency, seek immediate assistance from our staff or call emergency services. Our Instructor(s) are not necessarily trained in first aid but have experience with workshop injuries and can give suggestions for how you can apply first aid to yourself. Our staff is not expected to perform first aid on you. However, if the staff is comfortable and ready, they may attempt to aid you and will ask you if you require help. If you verbally consent, they will try their best to help and cannot be held liable for harm that results from their best intentions in the moment or after. If you are unable to consent due to a lack of consciousness or for other reasons, If injured, aid may be given based on the staffs best judgment while an ambulance is called to come get you.

5.7 Bio-Hazard Replacement Fee

We will not be cleaning bodily fluids off of our tools and workstations. If you bleed on the tools and workstations, you may be asked to pay for the replacement of the soiled pieces, and the bloodied tool(s) or workstations will be sold to you for their market rate. An invoice for the fee will be sent to you using the information you used to register.

6. Instructor Qualifications and Responsibilities

6.1 Instructor Qualifications and Experience All instructors are qualified and experienced in woodworking and hold appropriate certifications.

6.2 Instructor Conduct and Responsibilities Instructors are expected to maintain a professional and supportive teaching environment. They are responsible for providing clear instructions and ensuring class safety.

​

6.3 Communication with Instructors Participants should communicate any concerns or questions directly with the instructor or contact us if further assistance is needed.

7. Intellectual Property

7.1 Ownership of Course Materials All course materials, including handouts, lesson plans, and videos, are the intellectual property of [Knowing Hand LLC] and are protected by copyright.

7.2 Use of Course Content and Intellectual Property Participants may use course materials only for personal use and may not reproduce, distribute, or share them without permission.

​

7.3 Restrictions on Reproduction and Distribution Reproduction or distribution of any course content without explicit written permission from [Knowing Hand LLC] is prohibited.

8. Code of Conduct

8.1 Behavior Expectations Participants must behave respectfully towards instructors and fellow students. Disruptive, offensive, or unsafe behavior will not be tolerated.

8.2 Harassment and Discrimination Policies We are committed to providing an inclusive environment free from harassment and discrimination. Any such behavior should be reported immediately. Participants are responsible for respecting all people in the space. This includes but is not limited to a person’s race, sex, gender, ability, sexual orientation, ability, religion etc. Language, or actions that target a member of a minority community based on prejudice towards their identity will not be tolerated. Warning and explanation may or may not be given to offenders as a courtesy. If the offender is unwilling to be held accountable, they may be dismissed or banned from the premises depending on the gravity of their actions.

8.3 Disciplinary Actions Violations of the code of conduct may result in verbal warnings, temporary suspension, or permanent dismissal from the class and premises, at our discretion.

8.4 Consequences for Violations Participants who are dismissed for violating our policies are not entitled to a refund.

9. Equipment and Materials

9.1 Provision of Tools and Materials We provide necessary tools and materials for each class. Participants should only use the equipment provided by us unless otherwise instructed.

9.2 Personal Equipment Requirements Participants may be required to bring personal safety equipment such as gloves or goggles. Specific requirements will be communicated prior to the class.

​

9.3 Loss or Damage of Equipment Participants are responsible for any loss or damage to equipment caused by their own negligence. Replacement or repair costs will be billed accordingly. Common wear and tear of tools is expected, dropping, prying, snapping, throwing, or otherwise reckless tool handling is considered part of negligence.

9.4 Material Costs and Reimbursement Any additional materials not covered by the class fee will be communicated in advance. Participants will be responsible for any extra costs.

10. Privacy and Data Protection

10.1 Collection and Use of Personal Information We collect personal information to process registrations and communicate with participants. This information is used in accordance with our Privacy Policy.

11. Termination and Suspension

11.1 Conditions for Termination of Enrollment We reserve the right to terminate your enrollment for any reason, including but not limited to failure to comply with these Terms and Conditions or disruptive behavior. Additionally, we may terminate your enrollment for observation of behaviors online or outside of our premises that do not comply with our code of conduct, or reasonably lead us to believe that you pose a risk to our member’s emotional or physical safety due to your online or external behavior. You will be notified of your termination of enrollment via the contact information you used to enroll.

11.2 Suspension Policies Suspension may occur for violations of class policies or safety concerns. Suspension periods will be determined on a case-by-case basis.

​

11.3 Refunds upon Termination or Suspension Refunds will not be issued for classes missed due to termination or suspension.

12. Limitation of Liability

12.1 Limitations on Liability for Injury or Damage Our liability for any injury or damage arising from participation in our classes is limited to the maximum extent permitted by law. By signing up for a class, or entering the premises, you acknowledge and accept the risks of being around woodworking tools and people using them. Tools may be dangerous and bodily injury is very possible when they are used incorrectly by beginners Knowing Hand LLC will not be held liable for injury or damage to your person or property.

12.2 Insurance Information We maintain general liability insurance but do not provide personal accident or health insurance for participants.

​

12.3 Indemnification Provisions Participants agree to indemnify and hold harmless [Knowing Hand LLC], its employees, and agents from any claims or liabilities arising from their participation in our classes.

13. Dispute Resolution

13.1 Procedure for Handling Disputes Any disputes arising from these Terms and Conditions or your participation in our classes should be addressed first through informal communication with us either in person or via email at [info@theknowinghand.com].

13.2 Mediation and Arbitration If a dispute cannot be resolved informally, it will be submitted to mediation and, if necessary, binding arbitration in [Madison, WI].

13.3 Governing Law and Jurisdiction These Terms and Conditions are governed by the laws of [Wisconsin, Dane County]. Any legal actions must be brought in the courts of [Wisconsin, Dane County].

By participating in the classes offered by Knowing Hand LLC (“we,” “us,” or “our”), you acknowledge and agree that we may take photographs and videos of you during class sessions. These images and videos may be used for various purposes, including but not limited to advertising, promotional materials, social media content, and other marketing activities related to Knowing Hand LLC.

15. Use of Photos and Videos

15.1 Purpose of Use
Photographs and videos featuring you may be used in the following ways:

  • Marketing and Advertising: To promote our classes and services on our website, in brochures, flyers, and other printed materials.

  • Social Media: To share updates, highlights, and engaging content on platforms such as Facebook, Instagram, Twitter, and others.

  • Online Presence: To enhance our online presence, including on our website and through email marketing campaigns.

15.2 No Compensation
You acknowledge that you will not receive any compensation for the use of these images or videos. Your participation in our classes constitutes your consent to the use of your likeness as described above.

16. Photo and Video Opt-Out Procedure

16.1 Notification
If you do not wish to be photographed or recorded, you must notify us in writing prior to the start of the class. Please send an email to [info@theknowinghand.com] with the subject line "Photo Opt-Out" and include your full name and class details. If it is necessary that you not be photographed or recorded and cannot have any aspect off your image used in the cases stated above, you will need to contact us and inquire about which class days we will have no photos or videos taken. 

16.2 Accommodation
We will make reasonable efforts to accommodate your request to opt out of photography and videography. However, please be aware that we may not be able to guarantee that no photos or videos will be taken in all circumstances, particularly in group settings where it may be difficult to avoid capturing your likeness. When using photos , we can edit the photo or video to omit, cover, or blur your face or identifying features. If you have a specific request for how you would like to be omitted from photos, via blurring, cropping or covering, please indicate that in your opt-out email.

16.3 Special Requests
If you have specific concerns or require special accommodations regarding photography and videography, please communicate these to us as early as possible. We will do our best to address your concerns in a manner that respects your preferences while maintaining our operational needs.

17. Withdrawal of Photo and Video Consent

17.1 Post-Class Requests
If you have initially consented but later wish to withdraw your permission for the use of your photographs or videos, please contact us at [info@theknowinghand.com]. We will review your request and make reasonable efforts to remove or cease using the images or videos from future marketing materials and online content. Please note that removal from already published content may not always be feasible. 

17.2 Effective Date of Withdrawal
Withdrawal of consent will be effective as of the date we receive your request. We will cease using your images or videos in new content but cannot remove or alter content that has already been published or distributed.
